Bringing AI to the front desk raises an obvious worry: does letting software hear a prospective client's story put privilege at risk? The honest answer is that it depends entirely on how the tool is deployed.

What privilege actually protects

Privilege protects the confidential communication between a client and a lawyer, made to obtain legal advice. It does not protect the underlying facts. The crash, the date, and the injury exist whether or not anyone writes them down, and they are discoverable from the client directly.

That distinction matters, because most fear about AI intake is really fear about the facts, which were never privileged to begin with.

An agent of the firm, not a third party

Attorney-client privilege can extend to agents whose participation helps counsel provide legal advice, depending on the facts and jurisdiction. Decisions associated with In re Kovel are a common reference point for that analysis.

Firm direction and attorney review are intended to preserve an agency relationship. Privilege remains fact-specific, and consumer chatbots present a different set of facts.

What careful firms require

  • No-training model providers under contractual data-protection terms, including zero-data-retention API terms where available.
  • Short retention, with firm-specific isolation configured and validated during the signed implementation.
  • AI output labeled unverified until an attorney confirms it.
  • A conflict check before any case facts are taken.
  • A human attorney reviewing every matter.

The signed implementation should document these controls, and the firm should review them with its own counsel.

The legal limit

No architecture makes facts privileged that were not, and no vendor should promise that it does. The narrower position is that firm-directed, human-reviewed intake is designed to perform the role of the firm's agent. Privilege remains fact-specific, and the underlying facts do not become privileged merely because the system records them.
